The story of Al-Mughira ibn Shu’ba, who was the emir of Basra before ‘Umar. He was married but got alone with a woman in the house where he was staying with Abu Bakra, Nafi’, Shibl ibn Ma’bad, Nafee’, and Ziyad ibn Umayya; all of these men were competent. And a wind blew which opened the door where Al-Mughira was, and they saw that he was on top of the woman’s belly doing what a husband does with his wife. When they got up the next morning, Al-Mughira set out to the mosque to pray, but Abu Bakra said to him: Get away from our place of prayer. And the story spread, and ‘Umar got word of it, and they wrote, and he wrote back that they should all report to him. When they got there and showed up at his assembly place, Abu Bakra began, gave witness of the adultery, and described it. And ‘Ali said to Al-Mughira: There’s one fourth for you. Then Nafi’ gave witness after him, and ‘Ali said to Al-Mughira: There’s half for you. Then Shibl ibn Ma’bad gave witness after him, and ‘Ali said to Al-Mughira: There’s three out of four for you. And ‘Umar said: I would like all four. So Ziyad came forward to give witness, and ‘Umar said to him: Oh releaser of punishment! Say what you have to say, and I hope you do not shame any of the Companions of Allah’s Messenger (SAW). Then Ziyad thought carefully and said: I saw some legs crossed and some heavy breathing, and I saw him on her belly and her legs on his shoulders like two donkey’s ears, but I don’t know what was behind that. And ‘Umar said: Allahu Akbar my brother! Get up and whip these three! So they were whipped with the whipping for those who slander, and ‘Umar said to Abu Bakra: Repent and come forward to give your witness. But He said: I swear by Allah I will not repent, and I swear by Allah he committed adultery, I swear by Allah he committed adultery.
