وإن وطئ ميتة ففيه وجهان احدهما عليه الحد وهو قول الأوزاعي لأنه وطئ في فرج آدمية فأشبه وطء الحية ولأنه أعظم ذنباً وأكثر إثماً لأنه انضمّ إلى فاحشة هَتْك حرمة الميتة والثاني لا حد عليه وهو قول الحسن قال أبو بكر وبهذا أقول لأن الوطء في الميتة كلا وطءٍ لأنه عضوٌ مستهلك ولأنها لا يُشتَهى مثلها وتعافها النفس فلا حاجة إلى شرع الزجر عنها والحد انما وجب زجراً

If a man has intercourse with a dead woman, there are two points of view: one of them is that he is to be punished; this is what Al-Awza’i said, since it is intercourse in the vagina of a human female, and is similar to intercourse with a living woman, but because this is a greater offense and a more serious sin, since he has resorted to the disgrace of debasing a dead woman. The other point of view is that there is no punishment upon him; this is what Al-Hasan said. Abu Bakr said: I say this, since intercourse with a dead woman is like no intercourse at all, as it is a body part that is done with, and since no desire can be felt for such as her, and one feels disgust towards her, and so there is no need to prescribe rebuke concerning her, considering that punishment necessitates rebuke.
