Regarding his [Al-Haythami’s] words “a dead person” [mayyit] : not cognizant; and if he has not desired it, and there has been no ejaculation, no intent, and no erection, then the dead person need not be washed again if they have been penetrated or his penis has been made to enter in order to relieve the burden, like an animal; it is, however, necessary to wash them at death to clean and honor them. But no legal punishment is obliged for intercourse with a dead person.
