ولا فرق بين الوطء في القبل والدبر من آدمي أو بهيمة وبه قال الشافعي وأبو ثور ويتخرج في وطء البهيمة أن الحج لا يُفسد به وهو قول مالك وابي حنيفة لأنه لا يوجب الحد فأشبه الوطء دون الفرج
المغني لإبن قدامه مسألة فإن وطئ المحرم في الفرج فأنزل أو لم ينزل فقد فسد حجهما
There is no difference between intercourse in the front and in the rear, with a human or with an animal; Al-Shafi’i and Abu Thaur said the same in this regard. It is taught regarding intercourse with an animal that the hajj is not invalidated from it; this is what Malik and Abu Hanifa said, since the legal punishment is not obligatory, as this is similar to intercourse in other than a vagina.
