هذا مذهبٌ عليه عامة أهل العلم قال إبن المنذر أجمع عوام أهل العلم على أن حد من سب النبي ﷺ القتل وممن قاله مالك والليث وأحمد وإسحاق وهو مذهب الشافعي ... وقد حكى أبو بكر الفارسي من أصحاب الشافعي إجماع المسلمين على أنّ حد من سب النبي س القتل كما أن حد من سب غيره الجلد ... وتحرير القول فيه أن الساب إن ك ان مسلماً فإنه يُكفّر ويقتل بغير خلاف وهو مذهب الأئمة الأربعة وغيرهم ... وإن كان ذمياً فإنه يقتل أيضاً في مذهب مالك وأهل المدينة

This is a tenet which scholars generally hold. Ibn Al-Mundhir said: Scholars in general agree that the punishment for someone who slanders the Prophet (SAW) is death; among those who said this are Malik, Al-Laith, Ahmad, and Ishaq, and it is a tenet of Al-Shafi’i. … Abu Bakr Al-Farisi recounted – from the companions of Al-Shafi’i – the agreement among Muslims that the punishment for someone who slanders the Prophet (SAW) is death, just as the punishment for someone who slanders anyone else is whipping. … Drawing up what is said regarding this: the one who slanders, if he is a Muslim, is indeed declared a Disbeliever and is killed without dispute; this is the view of the four Imams as well as others. … If he is a dhimmi, then indeed he also is to be killed according to the doctrine of Malik and the people of Medina.
