There is disagreement regarding intercourse with menstruating women, once she has become pure [of menstruation], but before she has bathed [ghusl]. Malik, Al-Shafi’i, and the majority held that this is not permissible until she bathes, but Abu Hanifa and his companions held that this is permissible whenever she becomes pure for the maximum duration of menstruation, which for him is ten days. Al-Awza’i held that if the woman washes her vagina with water it is permissible to have intercourse with her.
