If the inhabitants of a certain territory apostatize, such that their land now becomes enemy land [dar al-harb], and the upper hand is gained over them, then their men are to be killed and their women and children taken captive, just as Al-Siddiq (may Allah Most High be pleased with him) did with the Banu Hanifa when they apostatized. If the women, when the Muslims defeat them, say: “We have not apostatized at all – truly we are Muslimas in our religion”, then they should say what they need to say for them to adhere to what is established, that is, Islam; and they are not taken captive, and likewise their young children, except if evidence arises among the Muslims of their apostasy.
