وإذا تزوج الحربي في دار الحرب إمرأة وابنتها في عقدة واحدة أو عقدتين ثم أسلموا قبل أن يمس واحدة منهما فعند ابي حنيفة رضي الله تعالى عنه إن كان تزوجهما في عقدة واحدة فنكاحهما فاسد وإن كان تزوجهما في عقدتين فنكاح الثانية فاسد وبمجرد العقد الصحيح على الإبنة تحرم الأم وبمجرد العقد على الأم لا تحرم الإبنة فلهذا صح نكاح البنت في الوجهين وبطل نكاح الأم وإن كان دخل بهما فنكاحهما باطل على كل حال بالاتفاق وإن كان دخل بإحداهما دون الأخرى فعلا قول محمد رحمه الله تعالى إن كان دخل بالأم بعدما تزوج الإبنة فنكاحهما باطل وإن كان دخل بالأم قبل أن يتزوج الابنة فنكاح الأم صحيح وإن كان دخل بالإبنة فنكاحها صحيح وإن كان تزوجهما في عقدتين فإن كان تزوج الإبنة أولاً ودخل بها فنكاحها صحيح ونكاح الأم باطل لأجل المصاهرة وإن كان دخل بالام فنكاحهما باطل لأن العقد على الإبنة كان صحيحاً وذلك يوجب حرمة الأم وقد دخل بالام وذلك يوجب حرمة الإبنة وإن كان تزوج الأم أولاً فإن دخل بها فنكاحها صحيح وإن دخل بالابنة بطل نكاحهما جميعاً لأن العقد على الإبنة لم يكن صحيحاً لمعنى الجمع والدخول بالابنة مبطل نكاح الأم ثم له أن يتزوج الإبنة دون الأم قال ولو تزوج الحربي أمة وحرة ثم أسلموا جاز نكاحهما في قول محمد رحمه الله قال وإذا تزوج الحربي أربع نسوة في عقدة أو عقدتين ثم سبي وسبين معه فعلى قول محمد رحمه الله تعالى يختار إثنتين منهن ولو تزوج حربي رضيعتين ثم أرضعتهما إمرأة ثم أسلموا فهذا وما لو كانتا أختين حين تزوجهما سواء على الخلاف الذي بينا وإن كانت انما أرضعتهما بعدما أسلموا فقد فسد نكاحهما جميعاً وكذلك لو أسلم الزوج وهم من أهل الكتاب ثم أرضعتهما إمرأة ولو كان تزوج الحربي كبيرة ورضيعة وللكبيرة لبن فأرضعت الصغيرة ثم أسلموا ففي قول ابي حنيفة رضي الله تعالى عنه نكاحهما فاسد ولو كان الارضاع بعد الاسلام بطل نكاحهما بالاتفاق بمنزلة ما لو تزوجهما بعد الاسلام وكذلك لو أسلم الزوج ثم أرضعت الكبيرة الصغيرة فقد فسد نكاحهما ولو كانت الكبيرة أسلمت وحدها ثم أرضعت الصغيرة فعند محمد رحمه الله يفسد نكاحها ويجوز نكاح البنت ولو كان الذي أسلم أبو الصغيرة ثم أرضعت الكبيرة الصغيرة فقد فسد نكاحهما جميعاً

If a fighter marries a woman and her daughter in enemy territory [dar al-harb] with a single marriage contract or with two contracts, and they yield into Islam before he has touched either of them, then according to Abu Hanifa (may Allah Most High be pleased with him): if he has married both of them in a single contract, marital relations [nikah] with them are invalid, but if he has married them in two contracts, marital relations with the second one are void, simply because a valid contract with the daughter makes the mother unlawful, but a contract with the mother does not make the daughter unlawful. For this reason marital relations with the daughter are upheld in both instances, while marital relations with the mother become invalid. If he has sex with both of them, then it is agreed that marital relations with both become invalid in all instances, but if he has sex with one of them and not the other, then according to what Muhammad (may Allah Most High have mercy on him) said, if he has sex with the mother after marrying with the daughter, then marital relations with both of them become invalid, but if he has sex with the mother before marrying with the daughter, then marital relations with the mother are sound; if he has sex with the daughter, then marital relations with her are sound. If he marries both of them with two separate contracts, and if he marries the daughter first, and has sex with her, then marital relations with her are sound and marital relations with the mother become invalid, due to the relationship established by marriage. But if he has sex with the mother, then marital relations with both of them become invalid, since the contract with the daughter was sound, and this necessarily prohibits the mother; however, he had sex with the mother, and this necessarily prohibits the daughter. If he marries the mother first, then if he has sex with her, marital relations with her are sound, but if he has sex with the daughter, marital relations with both of them become invalid, since the contract with the daughter was not sound, and by virtue of him getting together with and having sex with the daughter, this annuls marital relations with the mother. He may then marry the daughter without the mother. If an enemy fighter marries a servant girl and a free woman, and then they all yield into Islam, marital relations with both of them are permitted based on what Muhammad (may Allah have mercy on him) said. If a fighter marries four women in one contract or two, and is then taken prisoner, and the women are taken prisoner with him, then according to what Muhammad (may Allah Most High have mercy on him) said, he is to chose two of them. If a fighter marries two infant girls [radi’atain], and then another woman suckles them, and then they all yield into Islam, then there is no difference between this and if the two of them were sisters when he married them, in contrast to what we explained earlier. If indeed she suckles both of them after they have yielded into Islam, then marital relations with both of them become invalid; similarly if the husband yields into Islam and they are People of the Book, and then another woman suckles them. If a fighter marries a grown girl and an infant girl, and the grown one has milk and suckles the little one, and then they yield into Islam, then according to what Abu Hanifa (may Allah Most High be pleased with him) said, marital relations with both of them become invalid. Even if the suckling occurred after the Islam [after becoming Muslims], it is agreed that marital relations with both of them become invalid, by the same consideration as if he had married them after the Islam; similarly if the husband yields into Islam and then the grown one suckles the little one – marital relations with both of them become invalid. If only the grown one yields into Islam, and then suckles the little one, then according to Muhammad (may Allah have mercy on him), marital relations with her become invalid, but marital relations with the girl are permitted. If the one who yields into Islam is the father of the little one, and then the grown one suckles the little one, marital relations with both of them become invalid.
