٩٣٩ مسألة وأيما إمرأة أسلمت ولها زوج كافر ذمي أو حربي فحين إسلامها إنفسخ نكاحها منه سواء أسلم بعدها بطرفة عين أو أكثر أو لم يسلم لا سبيل له عليها إلا بإبتداء نكاح برضاها وإلا فلا فلو أسلما معاً بقيا على نكاحهما فإن أسلم هو قبلها فإن كانت كتابية بقيا على نكاحهما أسلمت هي أم لم تسلم وإن كانت غير كتابية فساعة إسلامه قد إنفسخ نكاحها منه أسلمت بعده بطرفة عين فأكثر لا سبيل له عليها إلا بإبتداء نكاح برضاها إن أسلمت وإلا فلا سواء حربيين أو ذميين كانا

Any woman who yields into Islam and has a disbeliever husband, either a dhimmi or part of a warring party, then when she yields into Islam, marital relations [nikah] with her are invalidated for him, whether he yields into Islam in the twinkling of an eye after her, or later on, or does not yield into Islam at all – there is no recourse for him to have her except by initiating nikah with her consent; otherwise, no. If both of them yield into Islam together, they both remain in their nikah. If he yields into Islam before she does, and she is of the People of the Book, then they both remain in their nikah – whether or not she yields into Islam. If she is not of the People of the Book, then at the moment he yields into Islam, nikah with her is invalidated for him; whether she yields into Islam in the twinkling of an eye or later on, there is no recourse for him to have her, except by initiating nikah with her consent if she yields into Islam; otherwise, no, regardless of whether the two of them are of a warring party or are dhimmis.
