قرآن ﴿ سبح لله ما في السماوات وما في الأرض وهو العزيز الحكيم هو الذي أخرج الذين كفروا من أهل الكتاب من ديارهم لأول الحشر ما ظننتم أن يخرجوا وظنوا أنهم مانعتهم حصونهم من الله فأتاهم الله من حيث لم يحتسبوا وقذف في قلوبهم الرعب يخربون بيوتهم بأيديهم وأيدي المؤمنين فاعتبروا يا أولي الأبصار ولولا أن كتب الله عليهم الجلاء لعذبهم في الدنيا ولهم في الآخرة عذاب النار ذلك بأنهم شاقوا الله ورسوله ومن يشاق الله فإن الله شديد العقاب ﴾ الحشر١-٤

قرآن ﴿ بأنهم شاقوا الله ﴾ وقد سبق بيان الآية الأنفال ١٣ و محمد ٣٢ قال القاضي أبي يعلى فقد دلت هذه الآية على جواز مصالحة أهل الحرب على الجلاء من ديارهم من غير سبي ولا إسترقاق ولا جزية ولا دخول في ذمة وهذا حكم منسوخ إذا كان في المسلمين قوة على قتالهم لأن الله تعالى أمر بقتال الكفار حتى يسلموا أو يُؤدُّوا الجزية وانما يجوز هذا الحكم إذا عجز المسلمون عن مقاومتهم فلم يقدروا على ادخالهم في الاسلام أو الذمة فيجوز لهم حينئذ مصالحتهم على الجلاء من بلادهم

تفسير إبن الجوزي

{ Let all that is in the heavens and in the earth glorify Allah, for He is mighty and wise. It is He who drove away from their dwellings those of the People of the Book who disbelieved, at the first gathering; you did not think that they would leave, and they thought that their fortifications would guard them from Allah, but Allah came to them from where they did not reckon, and flung terror into their hearts so that they destroyed their houses by their own hands and the hands of the Believers; so take heed, you who can see. If Allah had not decreed that they vacate, He would have punished them in this world, and the punishment of Hellfire is theirs in the hereafter. This because they antagonized Allah and His Messenger, and whoever antagonizes Allah, indeed Allah is severe in punishment } Al-hashr 1-4

{ This is because they antagonized Allah } : the explanations of Al-anfal 13 and Muhammad 32 have already preceded. Al-Qadi [judge] Abu Ya’la said: This verse is evidence that it is permissible to make conciliation with the other party in warfare with the stipulation of them vacating their homes, with no captives, no taking of slaves, no jizya, and no entering into a safeguarding agreement [dhimma]. However this ruling is abrogated whenever the Muslims have the power to fight them, because Allah Most High ordered that the Disbelievers [Kuffar] be fought until they yield into Islam or give jizya. Nevertheless this ruling is permitted whenever the Muslims are prevented from combating them and are unable to make them enter into Islam or dhimma; in this instance it is permissible to make conciliation with them, with the stipulation of them departing from their land.
