{ Say to those of the Bedouins who stayed behind: You will be called to a people of great might, you will fight them or they will yield; and if you obey, Allah will grant you a fine reward, but if you turn away as you turned away before, He will punish you painfully } Al-fath 16

It is clear that the ones being fought are not those from whom jizya is taken, since here only fighting or Islam are mentioned. The teaching of Abu Hanifa (may Allah Most High have mercy on him and be pleased with him) is that jizya is not accepted from Idolaters among the Arabs nor from apostates; it is either Islam or be killed.
