عن إبن جريج قال قلت لعطاء يطلقها حائضاً قال لا تعتدّ بها لتستوفِ ثلاث حيض قلت فطلقها ساعة حاضت قال لا تعتد بها قال بلغني أن النبي ﷺ قال لإبن عمر اردُدها حتى إذا طهُرت فطلّق أو أمسك
المصنف لعبد الرزاق كتاب الطلاق باب رجل يطلق امرأته ثلاثاً وهي حائض أو نفساء أهي تحتسب بتلك الحيضة
From Ibn Juraij who said: I said to ‘Ataa: Can a man divorce a woman when she is menstruating? He said: Don’t start counting the time for her; wait for three menstruation periods. I said: Can he divorce her when she starts to menstruate? He said: Don’t start counting; I heard that the Prophet (SAW) said to Ibn ‘Umar: Leave her as she is until she is purified, then divorce or keep her.
