قال علي من زنى بإمرأة ثم تزوجها لم يسقط الحد بذلك عنه لأن الله تعالى قد أوجبه عليه فلا يسقطه زواجه اياها وكذلك إذا زنى بأمة ثم اشتراها وهو قول جمهور العلماء وقال أبو حنيفة لا حد عليه في كلتا المسألتين قال أبو محمد رحمه الله وهذه من تلك الطوام فإن قالوا كيف نحده في وطء امرأته وأمته قلنا لهم لم نحده في وطئه لهما وهما امرأته وأمته وانما نحده في الوطء الذي كان منه لهما وهما ليستا امرأته ولا أمته …
قال أبو محمد رحمه الله ولو زنى بامرأة حرة أو أمة ثم قتلها فعليه حد الزنا كاملاً والقود أو الدية والقيمة لأنها كلها حقوق أوجبها الله تعالى فلا تسقطها الآراء الفاسدة وروي عن ابي حنيفة أن حد الزنا يسقط إذا قتلها فما سمع بأعجب من هذه البلية أن يكون يزني فيلزمه الحد فإذا أضاف إلى كبيرة الزنا كبيرة القتل للنفس التي حرم الله تعالى سقط عنه حد الزنا نبرأ إلى الله تعالى من ذلك ونحمده على السلامة منها كثيراً وبه نستعين

‘Ali [Ibn Hazm] said: Whoever adulterates with a woman and then marries her, the punishment is not lifted from him for that, since Allah Most High made it obligatory on him; his marrying her does not lift it. Similarly if a man adulterates with a servant girl and then purchases her. This is what most scholars say, although Abu Hanifa said there is no punishment for him in either case. Abu Muhammad [Ibn Hazm] (may Allah have mercy on him) said: If people say: How can we apply punishment to him for intercourse with his own woman or servant girl? We tell them: We do not apply punishment to him for having intercourse with either of them, they being his woman or servant girl, rather we apply punishment for the intercourse he had with them when they were not his woman or servant girl …
Abu Muhammad said: If a man adulterates with a free woman or a slave girl, and then kills her, the full punishment for adultery is upon him, including the retribution or the blood money and equitable value, since all these are rights that Allah Most High has made obligatory; vain opinions do not lift them. However it is narrated from Abu Hanifa that the punishment for adultery is lifted if he kills her. But nothing more astonishing than such a calamity is heard of – that a man adulterates, and the punishment is required of him, but if he adds to the crime of adultery the crime of killing a life Allah has forbidden, then the punishment for adultery is lifted; we are absolved to Allah Most High of this, and we greatly praise him for being blameless against it, and we turn to him for aid.
